How the Boundary Was Drawn

The proposed incorporation boundary follows the historically recognized Niwot community area. It was drawn using parcel data from the Boulder County Assessor and shaped by three main principles:

1. Community coherence. The boundary includes the residential neighborhoods, commercial areas, and civic spaces that make up the Niwot community as it exists today.

2. Legal requirements. Colorado law (C.R.S. 31-2-101) requires that the proposed area have at least 150 registered voters and form a reasonably compact, contiguous territory. The boundary meets both requirements.

3. Practical service delivery. The boundary was designed to create a manageable municipal footprint — one that can be served efficiently by a lean, contract-first town government.

Common Boundary Questions

Who gets to vote on incorporation?

Only registered electors (voters) who reside within the proposed boundary are eligible to vote on the incorporation question. Property owners outside the boundary do not vote, even if they own land inside it.

What if I live just outside the boundary?

If your property is outside the proposed boundary, incorporation would not directly affect your taxes, voting, or county services. Future annexation into the town would be a separate process requiring consent.

Can the boundary change?

The boundary in the petition is the boundary that goes to the ballot. After incorporation, the town could consider annexation requests from adjacent property owners, but the initial boundary is fixed by the petition.

I’m a renter inside the boundary. Does this affect me?

Yes — renters inside the boundary are eligible to vote and would experience the proposed 2.5% local sales tax on purchases. Renters do not pay the property tax directly, though it may factor into rental costs over time. See the tax calculator for estimates.

Does the boundary include Niwot’s commercial areas?

Yes. The 2nd Avenue historic district, Cottonwood Square, Monarch Park, and the Boulder Tech Center are all inside the proposed boundary.
