The Case

As an unincorporated community, Niwot has no authority over land use, zoning, or building codes. All of these are set by Boulder County, using regulations designed for the broader county context. When the county imposed a home-size moratorium in 2024 and permanent limits in 2025, Niwot homeowners were affected with no local recourse.

Incorporation would give Niwot the ability to adopt its own land-use code, tailored to the community’s scale and values. This doesn’t mean deregulation — it means local regulation, set by officials elected by Niwot voters. The town could create overlay districts to protect downtown character, pursue Certified Local Government status for historic preservation grants, and make zoning decisions that reflect Niwot’s identity.
